Terms of Service

4.1. Connection process

To benefit from the connection service, the User must:

1. Complete the contact form available on the Site
2. Provide accurate and up-to-date information (first name, surname, email, telephone, family situation)
3. Agree to be contacted by Partner Advisers by ticking the consent box

Once the form is submitted, the User's contact details are transmitted to one or more Partner Advisers selected by TheSmartMom.

A Partner Adviser contacts the User within 24 to 48 working hours, by telephone or email, to discuss their situation and needs.

4.2. Free service

The connection service is entirely free for the User. No fees will be charged by TheSmartMom to the User.

Partner Advisers are remunerated by insurance companies when a User takes out a contract. This remuneration does not result in any additional cost to the User.

4.3. No obligation to purchase

The User is under no obligation to take out an insurance contract after being contacted by a Partner Adviser.

The User is free to accept or refuse any proposals made by the Partner Adviser.

The User may at any time end the relationship with the Partner Adviser by informing them of their wish to no longer be contacted.

6.1. Limitation of liability

RBP Corp makes every effort to ensure the quality of the connection service. However, it cannot guarantee:

• The permanent availability of the Site
• The absence of errors or bugs on the Site
• The compatibility of the Site with all browsers and operating systems

RBP Corp cannot be held liable for:

• The use made by Users of information on the Site
• The acts, omissions or failures of Partner Advisers
• The quality, content or compliance of advice provided by Partner Advisers
• Failure to take out an insurance contract following the connection
• Direct or indirect damages resulting from use of the Site or inability to use it

6.2. Contractual relationship

The contractual relationship regarding the subscription of an insurance contract is established directly between the User and the Partner Adviser.

RBP Corp is not party to this relationship and cannot be held liable for any disputes that may arise between the User and the Partner Adviser.

In case of dispute with a Partner Advisor, the User should contact the Advisor directly or, where applicable, the relevant state insurance department.

9.1. Prior Express Written Consent

By submitting any form on the Site, you provide your prior express written consent, as defined under the Telephone Consumer Protection Act (47 U.S.C. § 227) and its implementing regulations, to receive telephone calls (including calls made using an automatic telephone dialing system or prerecorded voice), text messages (SMS/MMS), and emails from TheSmartMom, RBP Corp, and our Partner Advisors at the telephone number and email address you provided, even if your number is listed on any federal, state, or internal Do Not Call list.

You understand that this consent is not a condition of purchasing any goods or services. You are not required to provide this consent to make a purchase.

9.2. Data Sharing with Partners

By submitting your information, you agree that your personal data (including name, email address, phone number, ZIP code, and form responses) may be shared with one or more licensed insurance professionals, financial advisors, or service providers (“Partner Advisors”) for the purpose of contacting you about the products or services you requested.

Partner Advisors are independent professionals solely responsible for the advice, products, and services they provide. RBP Corp does not control how Partner Advisors use your information after it has been shared, and you should review each Partner Advisor’s own privacy policy and terms of service.

9.3. Opt-Out Instructions

You may revoke your consent at any time by any reasonable means, including:

• Replying “STOP” to any text message you receive from us
• Clicking the “unsubscribe” link in any email communication
• Emailing us at contact@thesmart.mom with the subject line “Opt-Out”
• Calling us and requesting removal from our contact list

Please allow up to 10 business days for your opt-out request to be fully processed. Opting out of communications from TheSmartMom does not automatically opt you out of communications from Partner Advisors. You must contact each Partner Advisor directly to opt out of their communications.

9.4. Message and Data Rates

Standard message and data rates may apply to any text messages sent or received. Message frequency varies based on your interactions. Your mobile carrier is not liable for delayed or undelivered messages.
